Definitions, characteristics and applications

Cookies are small text files that the sites visited by the user send and record on their computer or mobile device to then be re-transmitted to the same sites on the next visit. The use of cookies allows a site to remember user preferences (for example, the chosen language, font size, etc.) so that they do not have to be indicated again when the user returns to visit said site or you browse from one page to another of it. According to current legislation in Italy, the user’s express consent is not always required for the use of cookies. In particular, “technical cookies”, ie those used for the sole purpose of transmitting a communication over an electronic communications network, or to the extent strictly necessary to provide a service explicitly requested by the user, do not require this consent. In other words, these are cookies that are essential for the operation of the site or necessary to perform activities requested by the user.

Among the technical cookies, which do not require express consent for their use, the Italian Data Protection Authority (see Measure Identification of simplified procedures for the information and the acquisition of consent for the use of cookies ‘May 8, 2014 and subsequent clarifications, hereinafter also only “Provision”) includes:

“analytics cookies”, when used directly by the site operator to collect information, in aggregate form, on the number of users and how they visit the site,
navigation or session cookies (to authenticate),
functionality cookies, which allow the user to browse according to a series of selected criteria (for example, the language, the products selected for purchase) in order to improve the service provided.

On the other hand, a prior consent from the user is required for “profiling cookies”, ie those aimed at creating profiles relating to the user and used in order to send advertising messages in line with the preferences expressed by the user while surfing the net. .

Types of cookies used by the Site and the possibility of (de-) selection

Except for third-party cookies, for which reference must be made directly to the relative methods of selection and de-selection of the respective cookies, indicated by means of links; the Site, with the possibility of de-selecting them, uses the following cookies:

Technical navigation or session cookies: they are strictly necessary for the functioning of the Site or to allow you to use the content and services requested.
Functionality cookies: they are used to activate specific functions of the Site and a series of selected criteria (for example, the language) in order to improve the service rendered.

We delegate to these third parties, as already specified, the responsibility of providing the information and collecting the user’s consent, as required by the Provision. This responsibility is to be referred not only to the cookies that third parties send directly, but also to any additional cookies that are sent through our Site by virtue of the use of services that the same third parties use. In fact, with respect to these cookies, sent by service providers of the aforementioned third parties, the Data Controller does not have the possibility to exercise any control and does not know their characteristics or purposes.
